Welcome to Zaber (“Zaber,” “we,” “our,” or “us”). These Terms of Use (“Terms”) govern your access to and use of the Zaber mobile application and related services (the “Service”).

By creating an account, downloading, or using the Service, you agree to these Terms. If you do not agree, do not use Zaber.

 

1. Eligibility

You must be at least 13 years old to use Zaber. If you are under 18, you represent that you have permission from a parent or legal guardian.

You represent and warrant that:

  • You have legal capacity to enter into this agreement

  • All information you provide is accurate

  • You will comply with applicable U.S. laws

 

2. Description of the Service

Zaber is a social challenge app that allows users to:

  • Create and join timed challenges

  • Track device Screen Time usage

  • Compete based on lowest phone usage

  • View rankings and statistics

  • Manage accounts and subscriptions

Zaber uses third-party infrastructure providers, including Firebase, for authentication, cloud storage, and game synchronization.

We may modify, suspend, or discontinue features at any time without liability.

 

3. Accounts

You must create an account to access certain features.

You agree to:

  • Maintain accurate account information

  • Keep login credentials secure

  • Notify us of unauthorized access

You are responsible for activity under your account.

We may suspend or terminate accounts for violations of these Terms.

We may delete inactive accounts after 24 months of inactivity.

 

4. Screen Time Data & Anti-Manipulation Policy

Zaber accesses Screen Time data solely to:

  • Calculate challenge scores

  • Rank participants

  • Display performance metrics

You agree not to:

  • Manipulate device settings to falsify Screen Time

  • Use secondary devices to evade tracking

  • Exploit bugs or technical loopholes

  • Use automation or bots to alter rankings

We reserve the right to disqualify users or terminate accounts for tampering.

Zaber is not responsible for inaccuracies in device-reported Screen Time data.

 

5. Code of Conduct

You agree not to:

  • Harass or bully other users

  • Create offensive usernames or challenge names

  • Impersonate others

  • Post unlawful or infringing content

  • Interfere with the Service

We may remove content or terminate accounts at our discretion.

 

6. Subscriptions & Payments

Certain features may require a paid subscription.

By purchasing a subscription:

  • Payment is charged through your Apple App Store account.

  • Subscriptions automatically renew unless canceled at least 24 hours before the renewal period.

  • You may manage or cancel subscriptions in your iOS device settings.

  • Pricing is displayed in-app and may change with notice.

  • Refunds are governed by Apple’s policies.

  • If a free trial is offered, it will convert to a paid subscription unless canceled before the trial ends.

All payments are non-refundable except as required by law.

 

7. Apple App Store Terms

If you downloaded Zaber from the Apple App Store:

  • This agreement is between you and Zaber, not Apple.

  • Apple has no obligation to provide maintenance or support.

  • Apple is not responsible for addressing claims relating to the app.

  • Apple is a third-party beneficiary of these Terms and may enforce them.

 

8. User Content

You retain ownership of content you submit (e.g., usernames, images, challenge names).

You grant Zaber a non-exclusive, worldwide, royalty-free license to use, display, and distribute such content for operating and improving the Service.

We may remove content that violates these Terms.

 

9. Copyright Policy (DMCA)

If you believe content on Zaber infringes your copyright, you may submit a notice including:

  • Identification of the copyrighted work

  • Identification of the infringing material

  • Your contact information

  • A statement of good faith belief

  • A statement under penalty of perjury of accuracy

We may remove allegedly infringing material and terminate repeat infringers.

 

10. Health & Behavioral Disclaimer

Zaber is not a medical, psychological, or therapeutic service.

We do not provide medical advice or treatment for addiction.

We do not guarantee reduced screen time, improved productivity, or improved well-being.

Use of the Service is voluntary and at your own risk.

 

11. Intellectual Property

All rights in the Service (excluding user content), including software, trademarks, and design, are owned by Zaber.

You may not copy, modify, distribute, reverse engineer, or create derivative works without written permission.

 

12. Disclaimers

The Service is provided “AS IS” and “AS AVAILABLE.”

We disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose.

We do not guarantee:

  • Continuous or error-free operation

  • Accurate Screen Time reporting

  • Uninterrupted cloud synchronization

 

13. Limitation of Liability

To the fullest extent permitted by law, Zaber’s total liability shall not exceed the greater of:

  • $100, or

  • The amount you paid to Zaber in the past 12 months

We are not liable for indirect, incidental, consequential, or punitive damages.

 

14. Indemnification

You agree to indemnify and hold harmless Zaber and its affiliates from claims arising from:

  • Your use of the Service

  • Your violation of these Terms

  • Your violation of law or third-party rights

 

15. Dispute Resolution & Arbitration Agreement

You agree that any dispute arising from these Terms or the Service will be resolved through binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.

  • You waive the right to a jury trial.

  • You waive the right to participate in a class action.

  • Arbitration will occur in Louisiana.

  • You may bring claims in small claims court if eligible.

You may opt out of arbitration by emailing support@biggamestudiosllc.com within 30 days of account creation.

 

16. Export Compliance

You represent that you are not:

  • Located in a country subject to U.S. embargo

  • On any U.S. government sanctions list

You agree to comply with U.S. export laws.

 

17. Force Majeure

We are not liable for delays or failures caused by events beyond our reasonable control, including:

  • Internet outages

  • Cloud provider failures (including Firebase)

  • Natural disasters

  • Government actions

 

18. Termination

We may suspend or terminate access if:

  • You violate these Terms

  • You engage in fraud or manipulation

  • We discontinue the Service

You may stop using Zaber at any time.

 

19. Governing Law

These Terms are governed by the laws of the State of Louisiana, without regard to conflict of law principles.

 

20. Changes to These Terms

We may update these Terms from time to time. Continued use after changes constitutes acceptance.
